Klacht: Incorrect information by representatives and now I am stuck with two year subscription (without a training entry allowed in the gym)

Een klant van Happy Bodies heeft klachten over onjuiste informatie van vertegenwoordigers met betrekking tot de annuleringsvoorwaarden van zijn tweejarige abonnement. Ondanks herhaalde vragen over de mogelijkheid om na drie maanden te annuleren, kreeg hij te horen dat dit mogelijk was, terwijl hij nu vastzit aan het abonnement zonder toegang tot de gym. Bovendien was hij niet goed geïnformeerd over de details van de voorwaarden tijdens het inschrijvingsproces.

Mijn Klacht:

Here is what happened in my case:-

1. Both at the time of subscription query and actually taking subscription I checked with the guys 5-6 times on what are the conditions of cancellation after 3 months
and I clearly told them that I will not be able to continue for more than 1 year, still they kept telling me that anyway you can cancel after 3 months and the 2 year subscription is cheaper than
one year subscription so you should enroll in 2 year subscription.
Now i feel such a fool I was to trust those guys!

2. Then at the time of subscription, I was just asked to fill in some details on the tablet and rest was taken care by one of your coaches. I was not informed that I can read the detailed
teams and conditions there and there was additional conditions from what I was told.

3. At the time of closure:-
a) When asked for refund – This was the time I was told, that there are some conditions (which this guy said he was not aware of) and if you meet these conditions, you will get the refund. But I did not bother about refund, as I trained there for those months.
b) For payments for upcoming months – The guy told me that I do not need to pay further and he will make the payment debit cancellation request right away
and that the my account at Happy Bodies is closed starting that date and I shall not train there any further(He took my entry pass as well stating the closure of membership).

This is really unethical and unprofessional behavior from Happy Bodies. When contacted them via email for this they said:-

Our coaches at the club are there to properly guide the members during exercise. For all administration questions you can always contact us.

If the coaches are not well informed of the policies, than there should be people from admin department at the gym to pass on the correct information to a potential client.

If I had been informed of correct policy at the time of taking membership, I would have definitely think again about my decision to join.

Also a very basic and logical thing I want to mention here is if at the time of closure, the representative would have correctly informed me that they will keep taking money from my account and still not allow me to train at gym after I cancel, why on earth i would cancel the subscription for the service I will not be allowed? In that case, I would have kept my membership and continue to use their facilities.

Now Happy Bodies is asking to bring in the collection agency in between but not listening to my request to listen to discuss out my concerns on incorrect information provided to me and resolve it .

Gewenste Oplossing:

Closure of my subscription effective from the date I requested(30th sept 2019) as promised by the Happy Bodies representative who worked on my cancellation request and stop asking for further payments.
