Een klant van Basic Fit heeft zijn contract enkele maanden geleden beëindigd vanwege financiële problemen door de pandemie, maar ontvangt nog steeds facturen. Ondanks zijn verzoek om beëindiging en de sluiting van de sportschool, blijft hij worden aangesproken op betalingen tot juni 2021. Hij ervaart geen respons van het bedrijf op zijn klachten en ontvangt dreigende berichten om te betalen.

Mijn Klacht:

A couple of months ago, I terminated my contract as I had only visited BasicFit ONCE this year due to the pandemic. I explained that I would no longer be able to pay the fees as I’ve had to take salary reduction and tighten up my entire budget. It was my understanding that my contract had been terminated. I am still being charged. Also – even though gyms have been closed most of the time due to covid. This is not fair.

I originally started my membership on 9 January 2020 and am expected to pay until 19 June 2021?? How is this even possible, as this is longer than a 1 year contract in any case. 

I am now getting threatening mails and messages to pay – but NOBODY has responded to me to help with this issue. I do not want to be charged further than January, already that is too long since I terminated my contract months ago. 

Gewenste Oplossing:

When there is finally a response acknowledging my termination from months ago and not expecting me to keep paying for a service that is not available.

Hi Jacqueline,

Thank you for your message.

Sorry to hear that you had this experience with us. I've checked this for you right away.

You registered yourself with an annual contract. An annual contract consists of at least 52 paying weeks. When registering, you took advantage of the promotion “8 weeks of free sports”. The free period preceding the annual contract is not deducted from this. Your annual contract started on 3/5/2020.

So you do pay for an annual contract but with the advantage that you can exercise for free from the registration date until the start date of your membership.

Due to the situation regarding Corona, you have chosen to freeze your membership. A freeze means that the membership is paused.

The period during which the clubs were closed (3/16/2020 - 7/1/2020) has been added to the membership, which means that the end date will be postponed. In this way the agreement still consists of at least 52 paying weeks.

The end date of your membership is 6/19/2021. It's not possible to end it earlier.

Unfortunately we have to close the clubs again. You do not have to pay anything for the period in which the clubs are closed.

Because it is not yet known which result this second lockdown has for your membership, I cannot yet make a statement about this. As soon as more is known about this, we will inform you personally by e-mail as soon as possible.

The problem is that this was never made clear from the beginning. Of course the freeze option would be chosen if the clubs were closed - why would anyone want to pay for a service that the cannot use? It should have been CLEARLY stated that it meant that membership would be extended past the normal time then. Based on all the complaints and bad reviews of BasicFit, I am not the only one that feels cheated on this matter. I will never recommend this company to anyone based on this experience. We've all had to take some knocks due to the pandemic. What surety do I have that the contract wont continue being extended because of having to be closed again? It is a ridiculous business model and proves that the only concern is money, not customer service.
