Mijn Klacht:

The Van Hoek Partners Incassoservices B.V. are requesting in behalf of AnyTime Fitness Groesbeek the amount of 429.45 euros, for a service that was not provided because the gym was closed.

I transferred the total amount for the months where AnyTime was open.
From 1.7.2020 until mid December (let’s say 15.12.2020) are just 6 months if we include fully the month of December (July, August, September, October, November and December, 40.95 euro x 6 moths 245.7 euro).
From 1.4.2020 until 1.7.2020 the gym was closed ( Aprille, May, June) and is closed again from 15.12.2020 till… who knows how long (today date is 30.1.2021 and fore sure will be close at least till 9.2.2021).
Based on the contract agreement, I don’t have to pay for the months where the gym was closed, and the contract can be terminated at any time because the gym failed to provide the services.
16. Obligations of the Club
The Club guarantees that the activities and services provided correspond to the Agreement.
My contract ended on January 2021 and Van Hoek Partners Incassoservices B.V. also AnyTime Fitness Groesbeek failed to acknowledge this fact.
Also I have prof of transfer of 245.7 euro to the NL54INGB0673034615 account, for the months were the gym was opened (July, August, September, October, November and December).

Also next day Van Hoek Partners Incassoservices B.V. will not acknowledge my transfer of 245.7 euro to the NL54INGB0673034615 account(account provided by them), for the months were the gym was opened (July, August, September, October, November and December) and asking again 429.45 euros plus collection costs.

I want to mention that is company looks to run some kind of scamming business and harassing people with legal actions.

Gewenste Oplossing:

The claim is annulled and the file 580106 / AnyTime Fitness Groesbeek is closed.
