Dear bol.com Webcare Team,
Under return tracking number 3SCJRG2442777, your courier collected a return package from my address. This package arrived successfully at your distribution centre. Bol.com has since officially acknowledged receipt of this package by returning one of the helmets that were inside the box.
However, this box also contained a further 4 horse riding helmets from Decathlon that were not intended for bol.com, with a total replacement value of €204.80 (provable via the original Decathlon invoice and the shipping weight logged by the courier).
Now that the box has been opened by your distribution center, bol.com has legally taken physical custody of my private property under Dutch law (Article 7:600 BW – Duty of Care/Bewaarneming). Your customer service department has already internally acknowledged this error by offering me a €55 goodwill gift voucher. I have formally rejected this offer in writing, as it does not cover the actual damages of €204.80, and bol.com has no right to appropriate or carelessly lose someone else’s property.
I have already sent bol.com a formal notice of action giving them a strict 14-day deadline to locate my items or reimburse the €204.80 in full. If this is not resolved via a standard bank transfer in a timely manner, I will immediately initiate a binding legal case with the Geschillencommissie Thuiswinkel on the 15th day.
I request a manual escalation by a warehouse supervisor to trace these missing ‘unregistered goods’ in your facility or to pay out the property damage claim of €204.80 in cash.
Gewenste Oplossing:
Ik verzoek om volledige financiële compensatie van €204,80 via een bankoverboeking, of om de vier paardrijhelmen kosteloos terug te sturen naar mijn adres.
