Mijn Klacht:

My name is Mateusz Stemplewski and I am contacting you to due to my problem with employment agency Werckpost. Same problem concern my two co-workers: Olaf Warzocha and Maciej Justyna.

Main issue we noticed was wrong is wage per hour: 9.44 euro per hour when in our contract it is clearly stated that it is 10.94 euro per hour. Werckpost employees stated with conversation in Netherlands with me and my co-workers that it is a mistake made because of miscommunication on their side and error will be corrected. Another mistake was to charge accommodation costs from our netto earning not brutto, where it was clearly stated before signing contract that it would be charged from brutto amount.

Now as we came back to Poland and we received our promised correction and it came out to be calculated wrongly again. Our wage per hour was not corrected and Werckpost refused to change it. First of their explanations was that our wage is different for different jobs which is clearly untrue because in our contract it is stable amount and not job-specific. Second answer we heard is that it can be changed without us agreeing or even informing which is also untrue due to the law. Also I would like to note that salary from first week is calculated correctly. We are also waiting for holiday allowance- in compliance with the law 8% brutto and second 10.39% brutto. We were told that we have to wait 5 weeks more.

Gewenste Oplossing:

Our aim is to receive fair salary for our work and in accordance to contract we signed. We do not seek for anything beyond that. Because of the fact we are currently not in Netherlands and that our problem seems to be a legal issue we will be forced to contact polish consulate for help and guidance if the issue will not be solved.
